Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BuyVerifi.com website, mobile applications, and related services (collectively, the "Platform"), operated by BuyVerifi, LLC ("BuyVerifi," "we," "us," or "our").

By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you may not use the Platform.

1. Description of Services

BuyVerifi is a marketplace platform that connects buyers seeking verification of products listed for sale on third-party marketplaces with independent third-party contractors ("Verifiers") who perform inspection and verification services.

BuyVerifi does not buy, sell, inspect, store, transport, guarantee, authenticate, or take possession of any goods. BuyVerifi only facilitates communication, job posting, and payment processing between users.

2. Eligibility

You must be at least 18 years old and legally able to enter into binding contracts to use the Platform.

By using BuyVerifi, you represent and warrant that:

  • You are legally permitted to use the Platform
  • All information you provide is accurate and complete
  • You will comply with all applicable laws and regulations

3. User Roles

A. Buyers

Buyers may post requests for verification services and receive reports from Verifiers.

B. Verifiers

  • Verifiers are independent contractors, not employees, agents, partners, or representatives of BuyVerifi.
  • BuyVerifi does not control how Verifiers perform services, nor does it supervise, direct, or guarantee their work.

4. No Guarantee or Warranty

IMPORTANT NOTICE

BuyVerifi does not guarantee:

  • The accuracy, completeness, or truthfulness of any verification
  • That a product matches a listing description
  • That a transaction will be safe, legitimate, or scam-free
  • That a seller will complete a transaction
  • The quality, value, condition, authenticity, legality, or fitness of any product

All verification services are informational only and should not be considered professional, mechanical, legal, financial, or appraisal advice.

5. User Responsibilities

Buyers agree to:

  • Make independent purchase decisions
  • Understand that verification reports are opinions based on limited observation
  • Assume full responsibility for any purchase or transaction decision

Verifiers agree to:

  • Provide truthful and good-faith observations
  • Not misrepresent skills or credentials
  • Comply with local laws and safety requirements
  • Avoid trespassing or unlawful conduct

6. Payments & Fees

  • BuyVerifi charges a platform service fee for facilitating transactions
  • Verifier fees may vary by job
  • Payments are processed through third-party payment processors
  • BuyVerifi is not responsible for payment processor errors or delays
  • All fees are non-refundable once a verification service has commenced, except where required by law.

7. Independent Contractor Status

Verifiers are independent contractors, not employees.

Nothing in these Terms creates:

  • An employment relationship
  • A partnership
  • A joint venture
  • An agency relationship

Verifiers are solely responsible for:

  • Taxes
  • Insurance
  • Licensing
  • Compliance with laws

8. Limitation of Liability

To the maximum extent permitted by law, BuyVerifi, its owners, officers, directors, employees, and affiliates shall not be liable for:

  • Any inaccurate, incomplete, or misleading verification
  • Any loss, theft, damage, or defect in a product
  • Any failed, fraudulent, or disputed transaction
  • Personal injury or property damage
  • Lost profits, data loss, or business interruption
  • Indirect, incidental, consequential, special, or punitive damages

BuyVerifi's total liability, if any, shall not exceed the total fees paid by the user to BuyVerifi in the 30 days preceding the claim.

9. Hold Harmless & Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS BUYVERIFI

You agree to defend, indemnify, and hold harmless BuyVerifi, its officers, directors, members, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Platform
  • Any verification request or report
  • Any purchase, sale, or transaction
  • Any reliance on a verification
  • Any dispute between buyers, sellers, or verifiers
  • Any violation of law or third-party rights
  • Any misrepresentation or misconduct

This obligation survives termination of your account.

10. Assumption of Risk

You expressly acknowledge and agree that:

  • Peer-to-peer marketplace transactions involve inherent risks
  • Verifications are limited in scope and time
  • BuyVerifi does not control sellers, listings, or products
  • You voluntarily assume all risks related to your use of BuyVerifi.

11. Disputes Between Users

BuyVerifi is not responsible for resolving disputes between users.

You agree that:

  • Disputes must be resolved directly between the parties involved
  • BuyVerifi may, but is not obligated to, assist or mediate

12. Account Termination

BuyVerifi reserves the right to:

  • Suspend or terminate accounts at any time
  • Remove content
  • Refuse service for any reason, with or without notice

13. Intellectual Property

All Platform content, branding, trademarks, and software are the exclusive property of BuyVerifi. You may not copy, distribute, reverse engineer, or exploit any part of the Platform without written permission.

14. Privacy

Use of the Platform is subject to our Privacy Policy, incorporated by reference.

15. Arbitration & Governing Law

Binding Arbitration

Any dispute arising out of these Terms shall be resolved by binding arbitration, except for claims eligible for small claims court.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.

16. Modifications

BuyVerifi may update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.

18. Expert Disclaimer Addendum

These Expert Disclaimer Addendums ("Addendums") supplement and form an integral part of the BuyVerifi Terms of Service ("Terms"). In the event of any conflict, these Addendums shall control with respect to Expert Verification Services.

1. Definition of "Expert" Services

"Expert Services" include any verification, inspection, evaluation, opinion, assessment, report, commentary, or feedback provided by a Verifier who:

  • Claims specialized knowledge, training, experience, or credentials, or
  • Is categorized by BuyVerifi as an "Expert," "Specialist," or similar designation, or
  • Charges an enhanced or premium fee for services beyond basic visual verification.

Expert Services may include, but are not limited to:

  • Mechanical inspections
  • Electrical or electronic evaluations
  • Vehicle diagnostics
  • Equipment testing
  • Authenticity opinions
  • Appraisal-style assessments

2. No Professional Relationship

IMPORTANT NOTICE

Expert Services provided through BuyVerifi:

Do NOT create a professional-client relationship of any kind, including but not limited to:

  • Mechanic–client
  • Appraiser–client
  • Inspector–client
  • Engineer–client
  • Consultant–client
  • Are informational only
  • Are not a substitute for in-person, licensed, comprehensive professional inspections

BuyVerifi does not verify, license, certify, or guarantee any Expert's qualifications.

3. No Warranties or Guarantees

BuyVerifi expressly disclaims all warranties, express or implied, regarding Expert Services, including but not limited to:

  • Accuracy
  • Completeness
  • Professional competence
  • Fitness for a particular purpose
  • Compliance with industry standards

Expert opinions represent a limited snapshot in time and are subject to:

  • Environmental conditions
  • Accessibility limitations
  • Information provided by sellers
  • Hidden defects
  • Human error

4. No Appraisal or Valuation Guarantee

Unless expressly stated otherwise:

  • Expert Services are not formal appraisals
  • Expert opinions do not establish market value
  • Reports should not be used for insurance, financing, resale, tax, or legal purposes
  • Any estimated values provided are non-binding opinions only.

5. Assumption of Risk (Expert Services)

By requesting or relying on Expert Services, you:

  • Acknowledge the inherent limitations of remote or third-party inspections
  • Accept that defects may exist but go undetected
  • Assume full responsibility for any purchase decision

You agree that you rely on Expert Services entirely at your own risk.

6. BuyVerifi Not Responsible for Expert Misconduct

BuyVerifi is not responsible or liable for:

  • Negligence or errors by Experts
  • Misrepresentations of expertise
  • Fraudulent or misleading statements
  • Incomplete or incorrect evaluations
  • Licensing or certification deficiencies

Experts act solely in their individual capacity.

7. Limitation of Liability (Expert Services)

To the maximum extent permitted by law:

  • BuyVerifi shall have no liability arising from Expert Services
  • Any claim related to Expert Services shall be limited to the fees paid for the specific Expert Service at issue

Under no circumstances shall BuyVerifi be liable for:

  • Purchase losses
  • Repair costs
  • Diminution in value
  • Business losses
  • Consequential or punitive damages

8. Hold Harmless & Indemnification (Expert Services)

You agree to defend, indemnify, and hold harmless BuyVerifi from any and all claims arising from or related to:

  • Expert opinions or evaluations
  • Reliance on Expert Services
  • Disputes involving Experts
  • Alleged professional negligence
  • Product defects discovered after verification

This obligation survives termination of your account and use of the Platform.

9. Expert Credential Disclosure

Experts may voluntarily list:

  • Credentials
  • Experience
  • Certifications

BuyVerifi does not independently verify such information and makes no representations regarding accuracy.

10. No Insurance Representation

BuyVerifi does not represent that:

  • Experts carry professional liability insurance
  • Errors and omissions insurance exists
  • Any coverage applies to Expert Services

Users are responsible for obtaining independent inspections if desired.

11. Jurisdictional Limitations

Expert Services may not comply with:

  • State-specific inspection requirements
  • Licensing laws
  • Regulatory standards

Users are responsible for ensuring compliance with local laws.

12. Survival

These Expert Disclaimer Addendums shall survive:

  • Termination of accounts
  • Completion of services
  • Any transaction facilitated through BuyVerifi

By using BuyVerifi, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
